WACO—Attorneys for each side continue to fire off responses and replies in a federal district court over a Rockdale resident’s lawsuit, claiming his civil rights were violated by county officials.
In April, John L. Robertson filed a suit claiming he suffered two weeks of partial paralysis from the waist down and is now permanently disabled as the result of treatment while he was an inmate in custody of the Milam County Sheriff’s Department.
He listed as defendants Sheriff David Greene, District Attorney Bill Torrey, Chief Deputy Chris White, Former Sheriff’s Department Captain/Jail Supervisor Katrina Douglas, Jailer Jonathan Mendoza, Jailer Cindy McBee, Jailer Joshua Hughes, Jail Nurse Stephanie Vargas. Dr. Stuart Yoffe (inmate physician), Capt. Ryan Blankenmeyer and Milam County as an entity.
In early June the defendants filed a motion to dismiss the suit, stating the plaintiff (Robertson) failed to state a claim for which relief could be granted.
That was answered in late June when the plaintiff filed an amended complaint.
The defense countered with an amended motion to counter that amended claim.
The back-and-forth legal skirmishing is typical in such cases.
Robertson is represented by civil rights attorney Ty Clevenger of Brooklyn, New York.
The defendants are represented by the firm of Allison, Bass & Magee of Austin.
No specific amount of damages sought have yet been listed.
